Scope

These General Terms and Conditions (hereinafter “GTC”) govern the contractual relationship between oshore (hereinafter “we”, “us”) and customers (hereinafter “you”) for all orders placed through our online shop at oshore.ch.

By using our online shop and purchasing our products, you agree to these GTC as well as our Privacy Policy.

2. Offer and Conclusion of Contract

The product presentation in our online shop does not constitute a legally binding offer but an invitation to place an order.
By submitting your order, you make a binding offer to conclude a purchase contract.

After receiving your order, you will receive an order confirmation by email. The contract is concluded only once we confirm the shipment of the goods or dispatch the goods.

3. Prices and Payment Terms

All prices are in Swiss francs (CHF), plus shipping costs (unless otherwise stated).

Payment can be made using the payment methods offered in the online shop.
You agree to provide accurate and complete information when placing your order.

We reserve the right to change prices at any time. For orders already placed, the prices displayed at the time of purchase apply.

 

4. Delivery and Shipping

We deliver within Switzerland.

Delivery times are non-binding and serve as guidelines only.

Once the goods have been handed over to the shipping provider, the risk transfers to you.

We are not liable for delays caused by third parties or force majeure.

5. Returns and Right of Withdrawal

We voluntarily grant you a 14-day return period from the date of receipt of the goods.

Returned goods must be unused, undamaged, and in their original packaging.

Return shipping costs are at your expense unless the item was faulty or incorrectly delivered.

To exercise your right of withdrawal, simply send an email to info@oshore.ch including your order number.

Personalized products or hygiene items are excluded from the right of withdrawal.

6. Use of the Online Shop

You may use our shop only in accordance with applicable law and these GTC.

Abusive use (e.g., false information, automated access, virus distribution, harassment, etc.) is prohibited.

We reserve the right to suspend or delete user accounts in cases of suspected misuse.

7. Intellectual Property

All content in our online shop (texts, images, logos, designs, videos, etc.) is protected by copyright and may not be reproduced or commercially used without our written permission.

Trademarks, logos, and trade names of oshore or Shopify may only be used with written authorization.

8. Liability

We are liable only for damages caused intentionally or through gross negligence.

In cases of slight negligence, we are liable only for damages resulting from the breach of essential contractual obligations and only up to the amount of foreseeable damages.

Liability for consequential damages, lost profits, or data loss is excluded to the extent permitted by law.

Mandatory legal liabilities (e.g., under the Product Liability Act) remain unaffected.

9. Data Protection

The protection of your personal data is important to us.

Your data is processed in accordance with our Privacy Policy and Shopify’s privacy regulations (www.shopify.com/legal/privacy).
Data may be transferred abroad (e.g., to Canada or the USA), where Shopify operates servers.

10. Relationship with Shopify

oshore uses the Shopify platform to provide and technically operate the online shop.

All purchases and payments, however, take place directly between you and oshore.
Shopify is not a contractual party and is not liable for transactions, products, or services offered by oshore.

11. Changes to the GTC

We may amend these GTC at any time. The current version will be published on our website.

For orders, the version valid at the time of purchase applies.

12. Applicable Law and Jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction for disputes is [City, Canton], unless mandatory statutory jurisdictions apply.
